Imazon realiza capacitação sobre leis ambientais na APA Jará, em Juruti 4313a
Conselheiros da APA Jará tiveram o às principais informações da Lei de Crimes Ambientais
Os conselheiros da Área de Proteção Ambiental Jará, em Juruti, no oeste do Pará, participaram de capacitação sobre leis ambientais nesta quarta-feira (6), ofertada pelo Instituto do Homem e Meio Ambiente da Amazônia (Imazon) em parceria com a Secretaria Municipal de Meio Ambiente (Semma). O objetivo é informar o Conselho Gestor sobre os mecanismos legais de proteção e conservação da biodiversidade da Amazônia, para que a atuação da entidade seja fortalecida.
Para introduzir ao assunto, pesquisadores do Imazon Regiane Vilanova e Francisco Itamar explicaram que proteger a natureza é um dever do poder público, previsto na Constituição Federal, e que a sociedade tem o direito ao meio ambiente ecologicamente equilibrado. Também foi apresentado o conceito de crime ambiental, que é “toda e qualquer ação que resulte em danos à saúde, fauna, flora, recursos naturais ou patrimônio cultural, entre outros”.
Dentre os crimes contra a fauna, foi discutida a questão da caça e da pesca predatórias – atividades que são ameaças aos animais dentro da APA Jará – com as respectivas penalidades, que podem dobrar se o crime for praticado dentro de Unidade de Conservação, de acordo com a Lei nº 9.605, de 12 de fevereiro de 1998, conhecida como Lei de Crimes Ambientais.
“Uma das exceções é o caso de guarda doméstica de espécie silvestre, que não esteja ameaçada de extinção. Nesta situação, o juiz poderá deixar de aplicar a pena, dada as circunstâncias”, explicou Regiane Vilanova, que falou também sobre as atividades que demandam autorização dos órgãos competentes, como vender ou adquirir animais silvestres.
Para Elinaldo Alves, conselheiro da APA Jará, a capacitação foi muito esclarecedora e importante para a gestão da UC municipal, em Juruti. “Aprendemos sobre legislação ambiental e para nós isso é um ponto de partida, pois somos conselheiros de uma APA e a gente que vai de forma legal, ambientalmente correta, defender essa área. Então, precisamos ter essas informações e conhecer bem as leis de forma geral”, comentou.
Para finalizar, foi explicado também que existem algumas situações em que o crime é descartado, como abate de animal para saciar a fome de quem abateu ou de sua família, por exemplo.
Sobre a Área de Proteção Ambiental Jará
A Área de Proteção Ambiental Jará é uma Unidade de Conservação de uso sustentável localizada próxima a zona urbana de Juruti, no oeste do Pará, criada pelo Decreto Municipal n.o 4.174, em 3 de dezembro de 2019. Seu objetivo é proteger a biodiversidade, organizar o processo de ocupação do território e promover a sustentabilidade no uso dos recursos naturais (água, peixes, bacaba, etc.) para melhorar a qualidade de vida da população local. A APAJará possui quase 5 mil hectares, incluindo os lagos Jará, Tucunaré, Laguinho e margem esquerda do Curumucuri, onde residem cerca de 120 famílias.
