A regularização fundiária na Amazônia é um requisito essencial para redução de conflitos, redução de desmatamento e implementação de políticas mais sustentáveis na região. No entanto, a regularização de posses individuais só deve ocorrer quando não há conflito com direitos territoriais prioritários pela legislação, como o de povos indígenas, comunidades quilombolas, populações tradicionais e também conservação ambiental. O Programa Terra Legal estima que há 160 mil posses aguardando regularização na Amazônia e esse ivo já está coberto pela Lei nº 11.952/2009. Existem questões pontuais de aperfeiçoamento nessa lei, que não justificam o uso de uma Medida Provisória, que a rigor deve ser utilizada em casos de urgência. Além disso, a MP nº 759 extrapola ao sinalizar que as terras públicas não destinadas, que são patrimônio da população brasileira, estão disponíveis para apropriação ilegal, já que flexibiliza prazos para legalização de invasão de terra pública e permite cobrança de preços irrisórios para médios e grandes imóveis de até 1.500 hectares. Na prática, a MP promove uma ampla anistia ao crime de invasão de terras públicas previsto no Art. 20 da Lei nº 4.947/1966, ao permitir legalização de invasões ocorridas entre 2004 e 2011. Por isso, num período de crise econômica e de aumento do desmatamento, como observamos na Amazônia Legal desde 2012, a MP nº 759/2016 faz o contrário do que precisa ser feito. Nesse momento, a mensagem que o governo federal e o congresso precisam enviar à sociedade é de que não haverá tolerância com esse tipo de roubo do patrimônio brasileiro ao invés de anistiar essa conduta criminosa. Nesta análise, comparamos os artigos da MP nº 759/2016 com a Lei nº 11.952/2009 e também comparamos o texto da MP com as propostas de alteração da lei que estavam sendo analisadas até 2014 pela Secretaria Extraordinária de Regularização Fundiária na Amazônia Legal (SERFAL).
