O Projeto de Lei n.º 510/2021 visa alterar as regras de regularização fundiária em áreas federais, principalmente a Lei Federal n.º 11.952/2009. O PL é uma versão com alterações do texto da Medida Provisória n.º 910/2019, que não foi votada e, por isso, perdeu a validade no dia 19 de maio de 2020. A MP trazia dispositivos que estimulariam a continuidade de um ciclo de ocupação de terras públicas e desmatamento, conforme explicado em três notas técnicas publicadas pelo Imazon.
O novo PL n.º 510/2021 mantém ou agrava alguns desses riscos, além de trazer novos aspectos negativos, em especial:
Anistia o crime de invasão de terra pública[1] àqueles que o praticaram entre o final de 2011 e 2014.
Incentiva a continuidade de ocupação de terra pública e desmatamento, pois cria direito de preferência na venda por licitação a quem estiver ocupando área pública após dezembro de 2014, sem limite de data de ocupação.
Cria benefícios a ocupantes de médios e grandes imóveis em terra pública ao:
reduzir valores cobrados na titulação de quem já tem outro imóvel;
dispensar custas e taxas no cartório e no Incra para médios e grandes imóveis titulados;
ampliar prazo de renegociação de titulados inadimplentes;
ampliar prazo de renegociação de dívidas do crédito rural até dezembro de 2021.
Aumenta o risco de titular áreas em conflitos ou com demandas prioritárias, pois elimina a vistoria prévia à regularização e enfraquece os casos excepcionais em que a vistoria é obrigatória.
Permite titular áreas desmatadas ilegalmente sem exigir prévia de instrumento de regularização de ivo ambiental, nos casos em que não houve autuação ambiental.
Permite reincidência de invasão de terra pública, pois autoriza nova titulação a quem foi beneficiado com a regularização e vendeu a área há mais de dez anos. Assim, reforçará o ciclo vicioso de invasão de terra pública.
Amplia a possibilidade de extinção de projetos de assentamento para aplicação das regras de privatização de terras públicas, com risco de afetar assentamentos criados para populações agroextrativistas.
