Em 2017, o Ministério Público Federal (MPF) lançou o programa Amazônia Protege para responsabilizar desmatadores ilegais na Amazônia por meio de ações judiciais. Entre 2017 e 2020, o MPF ingressou com 3.561 ações civis públicas (As) abrangendo mais de 265 mil hectares desmatados R$4,6 bilhões.
Para identificar os desmatadores, o MPF utiliza laudos de órgãos ambientais que cruzaram dados de desmatamento obtidos por sensoriamento remoto pelo Instituto Nacional de Pesquisas Espaciais (Inpe) com mapas de imóveis rurais presentes no Cadastro Ambiental Rural (CAR) e sistemas de órgãos fundiários, como o Sigef, do Instituto Nacional de Colonização e Reforma Agrária (Incra).
Nos casos em que não foi possível identificar os responsáveis pela área desmatada, o MPF ingressou com As contra pessoas não identificadas, ou seja, réus incertos. Um dos objetivos dessa estratégia inclui solicitar o embargo e bloqueio da área, bem como a determinação judicial para apreender maquinários usados para o desmatamento.
Na primeira avaliação sobre os resultados dessas As, publicada em 2022[1], o Imazon identificou 650 sentenças de 1º grau emitidas até outubro de 2020, totalizando 18% do número de processos instaurados. Em 78% das 650 sentenças, os juízes decidiram pela extinção dos processos sem julgamento de mérito (506 casos), sendo a maioria destas ações iniciadas contra réus incertos. Apenas 8% (51 casos) haviam condenado os réus em primeira instância. No entanto, até outubro de 2020, somente dois destes condenados haviam pagado as sanções impostas.
Neste novo estudo, atualizamos a avaliação sobre os resultados das As do Amazônia Protege até dezembro de 2023, quando identificamos um total de 2.032 sentenças. Nosso objetivo é contribuir com o entendimento do papel do Poder Judiciário no combate ao desmatamento da Amazônia, identificando os principais argumentos jurídicos usados pelos juízes para embasar suas decisões e propor recomendações para fortalecer a responsabilização ambiental por desmatamento ilegal na esfera judicial.
